A seemingly minor disagreement over drink garnishes escalated into a violent assault Sunday night at the Hard Rock Cafe in Miami's Bayside Marketplace, leaving a 21-year-old bartender with significant injuries and prompting the arrest of a 47-year-old Texas man. Daniel Ramirez of Lubbock, Texas, faces felony battery charges following the incident, which was partially captured on surveillance video.

According to Nicky, the victim who requested anonymity beyond her first name, the altercation began After she politely asked Ramirez to cease picking through the drink garnishes. He was reportedly dining with his wife and family members at the time. The situation took a turn when Nicky stated she followed Ramirez, and he subsequently struck her in the mouth with a closed fist, resulting in a broken front tooth, a bruised lip, and a concussion. She initially underestimated the severity of her injuries, but subsequent medical evaluation revealed a more concerning picture.
“I am very grateful to the detective who took on this case,” Nicky told CBS News Miami by telephone, ahead of a dental appointment. “I am very grateful that justice has been served and they were able to arrest him. I had worried that he might leave for Texas before this happened.” She is currently grappling with post-concussion syndrome, experiencing daily headaches, shoulder pain, and a pervasive sense of anxiety. “This overall sense of anxiety follows me every day, every single day, and there is a hole in my chest,” she added, expressing profound distress.
The Hard Rock Cafe has released a statement emphasizing their commitment to the safety and well-being of their employees and guests, confirming their full cooperation with law enforcement. A spokesperson stated, “The Hard Rock Cafe Miami team member has our full support and we have been in contact with her regarding this troubling incident. Nicky, a senior at Florida International University studying computer science with aspirations of joining the U.S. Justice Department, indicated she is unlikely to return to her bartending job.
